MOTI (“we” or “us” or “our”) is the owner and provider of mobile and web-based services, which support and are parts of the MOTI measuring system, which is a screening system for physiotherapists to measure joint range of motion, quality of movement, and joint repositioning of the human body.

 

MOTI respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit and/or use our services; mobile application, and certain parts of our website (www.moti.dk), which are intended for use as is. Please read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS OR SERVICES.

 

When accepting this Privacy Policy by checking off ‘Agree to MOTI Terms & Conditions’ during registration in the mobile application and/or website, you confirm that you have read and agree and consent to our collection, transfer, storage, disclosure and use of your Personal Data as described in this Privacy Policy. Included is any information you provide, which is regarded as sensitive in relation to applicable law. You can withdraw your consent at any time, which means we will delete your personal information.

 

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of our Services after the date such revised Privacy Policy is posted.

 

This Privacy Policy does not apply to the third-party online/mobile store from which you install the mobile application or make payments, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

COLLECTION AND USE OF YOUR INFORMATION

Multiple categories of information are collected through the mobile application and/or website:

Registration Data

We collect your basic information you provide us during registration before you may access the full functionality of the mobile application. This information is referred as “Registration data” and include your name, email address, and/or other information.

Client Registration Data

The information you provide in the mobile application about your clients when registering them such as name, gender, date of birth, height, and weight, will be collected and stored in a database provided by us, but only accessible for you in the mobile application with your account. You are responsible for acquiring your client’s consent in order for you to enter their data in our Services and for us to store this data.

Usage Data

The data gathered through the mobile application with the MOTI measuring system in relation to your clients is uploaded to the cloud, only accessible for you through your account in the mobile application.

 

If you subscribe to the premium version of our mobile application, the data will be securely stored and accessible for you through our mobile application with your account until you either delete it, cancel your premium subscription, or withdraw your consent from this Privacy Policy.

 

In case you do not subscribe to our premium mobile application, the client data you save and gather with the MOTI measuring system are securely stored and accessible for you through our mobile application only in 30 days, hereafter it will be deleted.

 

We may anonymize the data in order to compare it with other collected data to summarize it in different categories.

Financial Data

Financial information, such as data related to your payment method (e.g. valid credit card number, card brand, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our services from Services. [We store only very limited, if any, financial information that we collect. Otherwise, all financial information is stored by our payment processor, Stripe, and you are encouraged to review their privacy policy and contact them directly for responses to your questions.

Geo-Location Information

We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using the mobile application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Access

We may request access or permission to certain features from your mobile device, including your mobile device’s [Bluetooth, camera, storage,] and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Data

Device information such as your mobile device ID number, model, and manufacturer, version of your operating system, phone number, country, location, and any other data you choose to provide.

Log Data

We want to inform you that whenever you use our mobile application, in a case of an error in the mobile application we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the mobile application when utilizing it, the time and date of your use of the mobile application, and other statistics.

In relation to if you submit Personal Data when reaching out to us through our website, we might collect this information.

Cookies

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory.

 

Our mobile application do not use these “cookies” explicitly. However, the mobile application may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of our mobile application.

Service and technology providers

We may employ third-party companies and individuals due to the following reasons:

 

  • To facilitate our Service;

  • To provide the Service on our behalf;

  • To perform Service-related services; or

  • To assist us in analyzing how our Service is used.

 

We want to inform users of this Service that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity.  If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party.  You acknowledge that such transfers may occur and that the transferee may decline honor commitments we made in this Privacy Policy.

 

We are not responsible for the actions of third parties with whom you share personal or sensitive data, and we have no authority to manage or control third-party solicitations.  If you no longer wish to receive correspondence, emails or other communications from third parties, you are responsible for contacting the third party directly.

We use administrative, technical, and physical security measures to help protect your personal information.  While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.  Any information disclosed online is vulnerable to interception and misuse by unauthorized parties.  Therefore, we cannot guarantee complete security if you provide personal information.
